On March 24, 2021, the Circuit Court of St. Louis City granted a motion to set aside a default judgment against clients represented by Behr, McCarter & Potter, P.C.
The case involved a lawsuit against a closely held corporation and a member of the corporation (sued in his individual capacity) over a dispute arising from an employment contract. Prior to our firm’s involvement in the case, the plaintiff was able to secure a default judgment and a subsequent damages judgment for $67,600 plus interest against our client. The client turned to Behr, McCarter & Potter, P.C. to try and overturn the Court’s orders. The issue was briefed and argued by Cameron Roark, and the Court granted the defendants’ motion to set aside the judgment. Despite the lack of procedural errors by the plaintiff in receiving the default, Cameron was able to successfully argue that defendants had a meritorious defense and that good cause existed to find in the defendants’ favor. The Court agreed.
